Federal Court Denies Rehearing on PennEast Pipeline Tied to Eminent Domain; Limited Options Remaining

The Federal Court has denied PennEast Pipeline's request for a rehearing on the recent ruling related to the developers efforts to condemn state-owned lands in New Jersey.  The company now has few alternatives moving ahead, including appealing the case to the Supreme Court or altering the route to avoid 40+ state-owned properties.  

The original decision had ruled that PennEast lacked the legal authority to seize state lands as a private company.  William Potter, a lawyer focused on energy issues, cited that the deal may kill the project.
